Terms of Service

These terms govern your use of aircomfortpros.com (the "Site") and, together with any written estimate or invoice, your service engagements with Air Comfort Solutions LLC, a Texas limited liability company located at 28215 Vallie St Bldg 1 Ste A, Pinehurst, TX 77362. By using the Site or booking service, you agree to these terms. If you do not agree, please do not use the Site.

Who we are and licensing

Air Comfort Solutions LLC is a heating and air conditioning contractor serving Tomball, Pinehurst, and nearby communities in Texas. Our work is regulated by the Texas Department of Licensing and Regulation (TDLR), P.O. Box 12157, Austin, Texas 78711, 1-800-803-9202. Our Texas air conditioning contractor license number is shown in the footer of every page of this Site. Our technicians are EPA certified for refrigerant handling.

Website use

• Site content is provided for general information about our services. It is not a substitute for an on-site diagnosis by a licensed technician. Do not rely on Site content to diagnose or repair equipment yourself.
• You agree not to misuse the Site. That includes scraping at abusive rates, attempting to breach security, interfering with other visitors, or submitting false, misleading, or automated requests.
• We may update, suspend, or remove any part of the Site at any time without notice.

Intellectual property

All Site content belongs to Air Comfort Solutions LLC or its licensors. That includes text, photos, graphics, logos, the eagle mark, page designs, and code. You may view, print, or save pages for your own personal, non-commercial use. You may not copy, republish, sell, or create derivative works from Site content without our written permission. All trademarks and brand names of equipment manufacturers shown on the Site belong to their owners and are used only to describe the products we sell and service.

Estimates, pricing, and payment

• We provide flat-rate, up-front pricing. The price you approve before work begins is the price you pay for the approved scope of work.
• Additional work discovered mid-job is always presented as a new option with a new price. It is never performed without your approval.
• Payment is due when the work is complete unless your invoice or service agreement says otherwise. We never collect card numbers through this Site. Any card payment is handled by our payment processor on its own secure systems.
• Financing is provided by third-party lenders (including Foundation Finance) on their own hosted application sites and is subject to their credit approval and terms. We do not make credit decisions and we do not receive your card or banking details.

Promotions and discounts

Offers listed on our Promotions page are subject to their stated terms, may change seasonally, and generally cannot be combined unless we say otherwise. One offer per household per service visit unless the offer says different.

Maintenance plan

The Comfort Maintenance Plan is billed annually at the price shown on the plan page at the time you join. Plan benefits are not transferable between properties without our approval. Either party may cancel before the next renewal.

Warranties and guarantee

Equipment carries the manufacturer's warranty. Our workmanship is backed by our 100% satisfaction guarantee: if something we did is not right, tell us and we will make it right. These terms do not limit any warranty rights you have under Texas law.

Communications and SMS consent

By submitting a form on the Site, you agree we may contact you about your request by phone or email. Text messages are sent only if you check the separate SMS consent box on the form. Limitation of liability

To the fullest extent permitted by Texas law, Air Comfort Solutions LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the Site, including lost profits or lost data. Our total liability for any claim arising out of Site use is limited to one hundred dollars. Nothing in these terms limits liability that cannot be limited by law, and nothing in these terms limits our responsibility for the quality of contracted service work, which is covered by your service agreement, our guarantee, and Texas law.

Indemnity

You agree to hold Air Comfort Solutions LLC harmless from claims and costs caused by your misuse of the Site or your violation of these terms.

Governing law and venue

These terms are governed by the laws of the State of Texas without regard to conflict of law rules. Any dispute arising from the Site or these terms must be brought in the state or federal courts located in Montgomery County, Texas, and you consent to the exclusive jurisdiction and venue of those courts. Disputes about performed service work follow your service agreement or invoice if it says otherwise.

Changes to these terms

We may update these terms from time to time. The "Last updated" date above shows the most recent revision. Continued use of the Site after a change means you accept the updated terms.
